3 questions to ask before accepting the role of an estate’s executor

On Behalf of | Feb 3, 2025 | Estate Administration |

If a loved one has asked you to become the executor of their estate, you need to obtain as much information as possible. Learning more can help you determine whether or not you should accept the role.

One of the ways to get the information you need is by asking the testator (the person who has drafted the will) questions. Below are three questions to ask:

1. What are my duties?

Chances are your loved one will inform you of your expected duties during the initial conversation. Nonetheless, you should ask follow-up questions to understand everything in depth. Learn more about your immediate responsibilities and those you will assume after the testator’s death.

2. How complex is the estate?

Being an executor of a complex estate differs from administrating one with fewer assets. Thus, ask the testator about the complexity of their estate to establish if you have the skills to serve as an executor or if you need to start working with professionals to gain the needed skills.

3. How much time does being an executor take?

You should know the amount of time performing your duties may take. Do you need to move between cities managing properties? Does the estate have any potentially conflicting matters that may affect the time it takes to close it? And so forth.

Generally, being an executor takes time. It can take months to a year, if not longer, for an estate to close. Therefore, assess the responsibilities in your life to determine if you will be able to give the estate the attention it needs.

These three questions can help you make an informed decision when requested to be an estate’s executor. Legal guidance can also help you learn more about the role.
